No Car Insurance – How Do I Claim For Damages To My Car And Personal Injuries?
I had a minor RTA with a neighbour. It was my fault but I’m not admitting that. I was overtaking him on a narrow country road and didn’t get past him without making contact. Anyway I want my car fixed and compo for whiplash. It turns out his insurance had lapsed. Do I go through my own insurance? Do I go through the MIB? or can I take a Civil Bill against him and take him to court which would possibly be more fun??? Thanks for help!

You were passing, and ran into him? Sue all you want, it isn’t getting you anything whether he has insurance or not. Judges don’t care what you want, they do care what is just, and unsafe passing doesn’t entitle you to claim against the person who was the victim of your unsafe act.
If you sue him instead of going to your insurance, he is going to sue you, guess who wins?
It is an at-fault accident. If you have collision coverage, your own insurance will fix your car, and possibly raise your rates. If your claims adjuster believes there is any possibility of assigning blame to the other driver, they will subrogate directly against him.

um if u were at fault nothing u can do…….u can submit it to ur insurance company but they won’t get u anything……u can sue him but if he can’t afford insurance don’t expect to get anything but a bill form ur lawyer…..
** also by admitting on here that u were at fault he can counter sue u……….

So you admit the accident was your fault…. but your going after a neighbor with no insurance? You sound like quite a guy. Go through your own insurance company and get your car repaired. It sounds like you don’t even have a police report so…..it will be difficult to even prove who was at fault. As far as your compensation for whiplash…I’d suggest just going in to a supermarket and “accidentally” slipping on a banana peel. I think that is how most douchebags get paid nowadays.

Strictly speaking, whiplash injury only occurs in the following circumstances:
The car you are in stops suddenly, usually by smashing into the one in front which stops without warning. Your head jerks forward.
Then another car smashes into the back of yours. Your head jerks backwards.
It is the combination of the abrupt jerk forwards and the almost immediate jerk backwards which causes the characteristic injury to the neck.
It doesn’t sound remotely possible that this is what you may have suffered.

mib is the best way but it will take ages for you get compensated. more than a year actually.

A sideways shunt does not give you whiplash and they will not acknowledge as being possible. Someone has already stated how whiplash occurs and the way you were behaving does not give you that right.
You admit it was all your fault and only idiots overtake on narrow country roads so that stacks against you and then you are actually smug enough to want to go after him for every penny you can for car repairs and a made up injury.
All in all it means you really are not a very nice person.
I suggest you try to chase him through your own insurance and then see how they evaluate it and where they stand. He had no insurance so use yours to get yours repaired. It will up your premiums but then again you deserve it.
Or try your civil bill if you have deep pockets as no one will want ot take it on no win and no fee and the experts will very quickly work out by damage done what really happened.
And you would do well to remember the old say which is ‘what goes around comes around’.
