Got Into Car Accident. My Faul According To Police. Lady Did Not Claim Injuries On Report. Can She Claim Later?

I was at a stop sign. pulled up a little to see if another car was coming. The crossing road was a 30mph zone. Out of no where this other car was coming down the road full speed (def above 30 mph). It was not going to hit me because i was not that far out. The other driver i guess thought it was going to hit me and it swerved its steering wheel and because of that she was able to hit my front on the side. She ripped off my entire bumper and right headlights. her car just had a dent on the front passenger side. She ended up stopping about a block away from where she hit me. Because i was at the stop sign the police said it was 100% my fault. The police asked if she was injured and she said no. My boyfriend spoke to her husband a day later and was claiming that the lady was “moaning and groaning”. I have a suspended license. How much trouble am i in?

    She can claim later that she was injured. If your license was suspended prior to the accident you will be in a lot of trouble because I doubt your insurance will pay, so you will end up paying it all out of pocket-expect to be sued.
    You also may end up in jail with a huge fine.

    Yes she can make a claim up to the statute of limitations. Basically each state has its own law that say how long a person has before they can’t make a claim and its typically a couple years. However if you have insurance, report it and they will deal with her and let you know if you have anything to worry about. If you have no insurance, you might be in a lot of trouble. She could potentially sue you. You would then have to pay any attorney fees out of your pocket and any judgment against you out of pocket. If you don’t have insurance and she or her insurance attempts to go after you, I would be adamant that you aren’t at fault. If she sues you and you are found not at fault then you wouldn’t have a judgment against you. I would state your case as you did here. However you may want to point out that although the police put you down as at fault that they did not witness the accident. That there were no witnesses. The police wouldn’t know whether you were stopped or moving since its your word versus hers. They have to prove your guilty. The police report may help them but its not the final decision on anything.

    Yes she can still claim injuries. Most injuries related to accidents can pop up weeks later. Such as back and neck pain and she would easily be able to find a doctor to back her up. She could sue your insurance company for damages and if she wins your insurance provider will probably raise your premium or drop you all together (they can do that at anytime). The suspended license carries a fine not sure for how much but it won’t be cheap. Sorry to hear about this situation your in. Good luck!

    Yes, depending on state laws, she has 2 or 3 years from the date of the accident to file an injury claim.
